General Terms and Conditions

Scope of Application and Language

These general terms and conditions apply to all services offered by Wellenkind Surfschool, including:

  • Surf courses
  • Guided tours
  • Equipment rental
  • Accommodation

The general terms and conditions are available in German, English, and Spanish. In case of doubt, the Spanish version will be the binding one.

Registration and Payment

Surf Courses and Guided Tours

  • Registration can be made in writing, by phone, or through our online booking system.
  • The registrant is responsible for the contractual obligations of all participants listed in the registration.
  • The booking confirmation will be sent via email to the provided address.
  • Payment must be made on the same day as the course, before it starts, unless otherwise agreed.

Campamento de surf

  • La inscripción puede realizarse por escrito o por teléfono.
  • Al reservar un curso de surf con alojamiento, se debe realizar un depósito del 20% del precio total en línea para confirmar la reserva.
  • El saldo restante se paga en el lugar.

Cancellation and Withdrawal by the Clients

Surf Courses and Guided Tours

  • Cancellations made at least 24 hours in advance: full refund or the option to choose a new date or receive a voucher.
  • Cancellations within 24 hours prior to the start: 50% refund of the course price.
  • In case of injury during the course or tour: a voucher valid for 2 years will be issued, but it is not transferable to other people.

Surf Camp

  • Cancellations up to 7 days before arrival: full refund.
  • Cancellations within 7 days before arrival: compensation for costs equivalent to 2 days of the trip price.
  • No-show: no refund.

Cancellations due to weather conditions

If an activity must be canceled due to weather conditions, we offer:

  • A new date
  • A voucher
  • If neither of these options is accepted, the full amount will be refunded.

Terms of Participation

The participant explicitly declares that there are no medical objections to practicing the offered sports.
It is mandatory to know how to swim and have a minimum level of physical fitness.
All instructions from the teaching staff or tour guides must be followed.

Minors

  • They can only participate with the consent of a legal guardian.
  • Consent is automatically granted upon registration for the course.
  • A written form is not required.
  • Payment for the course confirms this consent.

Inappropriate behavior

  • If irresponsible behavior endangers the health or reputation of the participants or Wellenkind Surfschool, the participant may be excluded from the course after a prior warning.
  • The course fee will not be refunded in these cases.

Insurance Details

  • Only guided activities such as courses and tours are insured.
  • Equipment rental (boards, wetsuits, etc.) is not insured and is done under the customer’s responsibility.
  • Damages or injuries occurring during insured activities are covered.

Loss or damage of equipment

  • The customer is responsible for any damage or loss of rented equipment.
  • The costs are calculated based on:
    • Replacement value
    • Repair costs
  • No matter how the damage occurred, the customer remains responsible.
  • By paying for the equipment rental, the customer accepts the rental agreement.
  •  Wellenkind Surfschool is not responsible for losses or damages caused by third parties.
  • Los vales son válidos por 2 años.
  • Si el vale no puede utilizarse en ese período por enfermedad, puede extenderse hasta 6 meses.
  • Los vales no son transferibles a otras personas, salvo casos excepcionales (familiares, por ejemplo).

Vouchers

  • Vouchers are valid for 2 years.
  • If the voucher cannot be used within that period due to illness, it can be extended for up to 6 months.
  • Vouchers are non-transferable to others, except in exceptional cases (e.g., family members).

Prescription

  • Claims against Wellenkind Surfschool for breach or defective performance are subject to a 1-year limitation period.
  • In cases of gross negligence or bodily injury, the limitation period does not change.

Warranty

  • Wellenkind Surfschool guarantees the completion of courses and tours as agreed.
  • If there are defects, the participant must report them immediately.

Liability

  • Participation in courses and tours is at the participant’s own risk.
  • Wellenkind Surfschool is only liable for damages caused by gross negligence or willful misconduct.
  • We are not responsible for lost or damaged personal belongings.
  • We are not responsible for damages caused by failure to follow safety instructions.

Data Protection and Use of Photos

Wellenkind Surfschool collects and processes personal data only for:

  • Booking management
  • Conducting courses and tours
  • Communication with customers

Photos and videos during activities

  • Photos/videos may be taken for marketing purposes.
  • They will be used in:
    • Website and social media

    • Printed material (brochures, posters)

    • Other advertising media

Participant Options

  • If you do not wish to be photographed, you must inform us before the activity begins.
  • If content has already been published, you can request its removal by emailing info@wellenkind-surfschool.com.
  • Photos of minors will only be used with explicit consent from the legal guardian.

  • If you book, your email will be used to send you information about offers and news.
  • You can unsubscribe at any time.

Severability Clause

If any provision is invalid, the rest will remain valid.

Equipment Rental

  1. The person signing the rental agreement or the renter must be over 18 years old and will be responsible for the rented equipment. This person must also present a National Identity Document or Passport, a copy of which will be taken.
  2. The rental payment must be made in advance, covering the total cost of the service, at the time of equipment pickup.
  3. The person renting the equipment declares that they have the appropriate skills in water sports, including handling and technical knowledge of currents, and therefore assume responsibility for their own safety.
  4. The renter declares that they are in good health and fit enough to practice this sport. They should take our recommendations into account according to their level and the conditions of the beaches.
  5. The surf equipment will be picked up at Wellenkind Surf School, located at Avenida del Istmo 6, La Pared, and returned to the same location at the agreed date and time. Serious failure to meet the schedule will result in an additional charge, depending on the extra time used. Returning the equipment before the end of the contract will not result in any kind of credit or refund.
  6. The renter is responsible for having their own insurance with appropriate coverage for risks that may arise during the rental period. The landlord is not responsible for claims related to accidents, injuries, impacts, or damages suffered by the renter or third parties (persons or property) during the rental period.
  7. The renter is informed that they must stay out of the private areas of the surf schools marked with flags while in the water.
  8. The renter must take care of the equipment and take all necessary precautions to protect it, such as not leaving the board face-up in the sun, not sitting on the equipment on the sand or rocks, and avoiding strong breaking waves.
  9. The surf equipment rental does not include wax. If the renter wishes to purchase a wax bar, an additional 3.50€ will be added to the total rental price. Without permission, wax cannot be applied to soft boards.
  10. The rented surf equipment may not be subleased, sold, or exchanged.
  11. The landlord may unilaterally revoke the contract before its completion in the case of serious breach by the renter regarding the use or care of the equipment. In this case, the landlord may take immediate possession of the equipment wherever it may be, without the renter having the right to any claim or compensation.
  12. The renter may extend the duration of the contract by informing the landlord before the expiration date, provided the equipment is not already reserved for the requested period.
  13. The renter will be responsible for paying the landlord the corresponding charges based on the rates specified in this contract for the use of the equipment, including applicable taxes, as well as the replacement cost or any other previously mentioned extra charges.
  14. All legal costs resulting from the renter’s failure to comply with the obligations outlined in this contract will be borne by the renter.
  15. The data provided by the customer will be used exclusively for the proper provision of the service outlined in this contract. The customer may request, in accordance with the law, access, rectification, cancellation, or opposition by contacting the landlord.
  16. The surf equipment must be returned in the same condition as when it was provided. If not, the renter must report any damages. The following replacement costs are established, which the renter accepts by signing this contract:

    Surfboards and bodyboards

    • Severe deterioration, partial or total deformation, partial or total breakage, loss, or theft: 200€ for a school board or 400€ for a Hard or Epoxy Soft board.
    • Partial damage according to its extent: fiber breakage (hole or crack), between 20€ and 50€.
    • Damages to the fin box or fin plugs, between 60€ and 80€.

    Leashes

    • Loss or theft: 15€.
    • Minor breakage or deterioration: no additional charge, as it is considered normal wear and tear.

    Fins

    • Breakage, loss, or theft (per unit): 15€.
    • Longboard: 30€.

    Wetsuits

    • Severe breakage, significant deterioration (zipper), loss, or theft: 50€.
    • Partial deterioration: no additional charge, as it is considered normal wear and tear.

    Vehicle straps

    • Deterioration, breakage, loss, or theft: 30€..
  17. This contract will be governed by the laws of Spain.
  18. The customer declares that they have read and accepted the above conditions.
